Former NFL quarterback Donovan McNabb convicted of DUI

Football fans in South Carolina may be interested to learn that former NFL quarterback Donovan McNabb was recently convicted of driving under the influence. The incident occurred on June 28 when the 38-year-old man was involved in a minor collision in Arizona. McNabb rear-ended a car at about 11:35 p.m. while the car was stopped at a red light in Gilbert.

After police determined that McNabb was impaired by alcohol, he was handed a non-extreme DUI charge. McNabb pleaded guilty to his charge and received a sentence of 18 days in jail followed by 90 days on house arrest. McNabb will begin his jail sentence on Nov. 30.

Despite the drunk driving conviction, McNabb insists that he does not have a drinking problem. While visiting Syracuse to see his college jersey retired, McNabb said 'absolutely not" when asked whether he has a drinking problem. During the interview with the Associated Press, McNabb admitted that the drunk driving incident could have been avoided and said that he was 'not running from it all." McNabb played for the NFL for 13 seasons.

There are many possible defenses that can be used to dispute a charge for drunk driving. A criminal defense attorney can review the circumstances in order to determine what the best strategy will be. In some cases, the field sobriety tests that were used can be challenged on the basis of their unreliability. Another argument is that police had no probable cause to conduct the traffic stop and that any resulting evidence should be excluded. If this is not possible, the attorney can often obtain an agreement from the prosecution to reduce the penalty in exchange for a guilty plea.
