South Carolina man charged with DUI after fatal crash

A South Carolina man from Clinton has been charged in a fatal motor vehicle accident that ended in a 16-year-old girl's death. South Carolina troopers say that the tragic incident occurred along Interstate 26 at approximately 12:50 a.m. on a recent Sunday. Troopers further allege that a 23-year-old man, who they say was driving the vehicle the girl was in, was driving under the influence at the time the fatal accident occurred.

Both the man and the girl were ejected out of the vehicle and, neither of them had been using seat belts, according to police. They were taken to the hospital and while the young man survived, the teenager died. Miraculously, another passenger who had been riding in the vehicle survived unharmed.

The alleged driver has refuted police accusations that he was driving under the influence. Indeed, the man says that the deceased girl was the one who had been driving the car. He said that before they left a club where they had been at previously that night, the girl had told them she would drive home. The defendant says that he cannot remember anything else after that moment.

This South Carolina DUI case is an example in which police accusations do not match up with the defendant's version of the facts. Prosecutors will now have to prove beyond reasonable doubt that this man was indeed driving the motor vehicle at the time of the crash. This is often difficult for prosecutors to achieve. The success of this man's legal defense may, therefore, rely on the eyewitness testimony of the uninjured passenger who was also riding in the car and may have witnessed -- and remembered -- who the driver was.
