A South Carolina man was recently killed in his yard by an allegedly drunk motorist in Florence County. The suspected drunk driving incident happened at approximately 6:30 p.m. on a recent Thursday evening while the victim was mowing his yard. According to the county coroner, the driver allegedly crossed the centerline of traffic before flying into the man's yard and hitting.
The victim succumbed to his injuries at the accident scene. He was 35 years old. According to South Carolina troopers, the 28-year-old man that hit him will face charges of driving under the influence in a fatal accident. He will also face charges of child endangerment. As of last reports, the defendant was being held at the detention center in Florence County.
South Carolina troopers will continue to investigate this incident to determine exactly how it may have occurred. Indeed, following police investigations, different explanations may be revealed as to what events transpired leading up to the accident. At this time, the driver has been accused of being under the influence of alcohol, but further evidence could be brought forward that changes the opinion of prosecutors.
In the event that a South Carolina resident is accused of causing a fatal accident while under the influence of alcohol, the charges must be handled delicately during criminal defense proceedings. Depending on the facts being brought against the accused, different kinds of strategies may be used in the individual's defense. For example, there may not exist sufficient evidence for the prosecution to prove that the individual was drunk driving. Alternatively, there may be evidence that shows the accident and/or fatality were not actually caused by the accused individual's intoxication.
