Marijuana testing has major technical problems

While the use of marijuana is not legal in South Carolina at this time, there is a pronounced trend towards legalization and decriminalization of the substance across the nation. With this upward trend in marijuana usage, however, comes the risk of driving under the influence.

Legal authorities through the nation are working to create a machine that can detect the precise amount of marijuana in a subject's bloodstream by measuring the chemicals present in their breath. However, there are many obstacles yet to be overcome when it comes to this testing.

Current research does not provide a means of establishing that a certain amount of THC corresponds to a level of impairment. Blood testing can indicate marijuana use for weeks after the event, but it cannot reveal how intoxicated a person is at a particular time. Thus, there is no one field test that can determine a person's impairment due to marijuana, as the breathalyzer does for alcohol. However, many bodies are working to develop a standardized test, and at least one company claims it will release a breathalyzer-like device in the near future.

If someone is accused of a serious legal infraction such as the possession of a prohibited chemical, then it may benefit them to contact an attorney and prepare a comprehensive legal defense. The penalties and punishments associated with drug possession have the potential to be life altering and severe. An attorney can help to find witnesses who can provide relevant testimony, challenge evidence that may have been collected improperly and in all other ways advocate for their clients.
